US EPA Notice of New Proposed Consent Decree

The U.S. Environmental Protection Agency (EPA) has recently published a notice in the Federal Register (89 FR 3396, Jan. 18, 2024) regarding a proposed consent decree in South Coast Air Quality Management District, et al. v. EPA, No. 2:23-cv-02646-JLS-PD (C.D. Cal.) and consolidated case (No. 2:23-cv-03545-JLS-PD). On January 18, 2024, EPA opened docket number EPA-HQ-OGC-2024-0012, available at https://www.regulations.gov/search?filter=EPA-HQ-OGC-2024-0012, to receive public comments on this proposal. The Federal Register notice and the text of the proposed consent decree are available in the docket. The comment period is open until February 20, 2024.

The proposed consent decree would resolve a complaint filed by South Coast Air Quality Management District, East Yard Communities for Environmental Justice, People's Collective for Environmental Justice, and Sierra Club alleging that EPA failed to perform certain non-discretionary duties in accordance with the Act to take final action on a state implementation plan (SIP) revision submitted by the State of California. EPA is providing notice of this proposed consent decree, which would resolve all claims in the case by establishing a deadline for EPA to take final action as specified in the decree.

EPA encourages your participation in the public comment process on the proposed consent decree mentioned above. Please submit any comments to EPA docket number EPA-HQ-OGC-2024-0012 by February 20, 2024, pursuant to the process outlined in the Federal Register notice. We welcome all comments that you may have, including comments indicating concurrence. Any comments received by EPA via email or other means outside of the regulations.gov platform will be directed to the docket where they will be available for public viewing. You are under no obligation to submit comments, and this notice does not require you to take any action.
